I am a large distributor that supplies many products to both the U.S. Government directly and through/to small and large businesses providing materials and services to the government. As part of that business relationship, we provide credit to these businesses. As in any organization providing credit, we conduct a risk assessment based on the financials of the company. We recently had one of our contractor customers assert that it would be a violation of their contract compliance to release their financial statements to our credit department. Our legal staff has not been able to locate any instance where this would be a compliance issue. Is there any statutory basis for withholding this information?
